Terms of Use

1. Eligibility and accounts

• You must be at least 18 years old.
• You must provide an email address you control and information that is not deliberately misleading or impersonating another person.
• You are responsible for keeping your password and account access secure.
• You may not sell, transfer, share or operate accounts for another person without our permission.
• You may not create an account for a minor or use G’Dayte to seek contact with minors.

We may use age, account, behavioural and moderation signals to investigate whether an account is eligible to use the service.

2. Likes, G’Days, Winks, Saves, matches and chat

A Like indicates match intent. When both members Like each other, a mutual match is created and those members can message each other for free while the match remains active.

Say G’Day and Wink are lightweight interest signals. They do not create a match, unlock private chat or override another member’s preferences. Save is a private shortlist action and does not notify the saved member.

We may apply reasonable anti-spam limits to Likes, G’Days, Winks, messages and other activity. These limits protect service integrity and are not a paywall.

3. Member conduct

You must treat other members lawfully and respectfully. You must not:

• harass, threaten, stalk, bully, blackmail or intimidate another person;
• send repeated unwanted G’Days, Winks, messages or other contact;
• impersonate another person or materially misrepresent who you are;
• solicit money, gift cards, cryptocurrency, financial credentials or participate in scams;
• use bots, scripts, scraping, mass messaging or automated account creation without written permission;
• post unlawful, exploitative, hateful, violent or non-consensual intimate content;
• share another person’s private information without permission;
• upload profile photos containing children;
• circumvent blocks, suspensions, rate limits or safety measures; or
• use G’Dayte for commercial solicitation, escort/service advertising or conduct unrelated to genuine adult social/dating use unless a feature expressly permits it.

Consent to meet, communicate, flirt or engage in any activity can be withdrawn at any time. A match, Like, G’Day or Wink is never consent to sexual activity, money transfers or off-platform contact.

4. Your profile and content

You retain ownership of content you submit. You give us a limited, non-exclusive licence to host, reproduce, resize, display and technically process that content only as reasonably necessary to operate, secure, moderate and promote the G’Dayte service. This licence ends when the content is deleted from active use, subject to backups, messages already delivered, legal requirements and reasonable safety/audit retention.

You must have the right to upload the content you submit. Do not upload another person’s private or copyrighted material unless you have the necessary permission.

5. Safety, reporting and moderation

Members can block, unmatch and report. We may use automated risk signals and human review to detect or investigate scams, harmful behaviour, underage concerns, abuse, spam or policy breaches. Automated signals are indicators, not guaranteed findings.

Depending on the circumstances, we may warn a member, restrict features, remove content, reduce visibility, pause an account, suspend or terminate access, preserve relevant evidence or refer a matter to appropriate authorities where required or reasonably necessary.

We do not promise to mediate every interpersonal disagreement. We prioritise service safety, legal obligations and serious policy violations.

6. Optional payments, boosts and promotions

Optional paid products may include discovery boosts, Premium, public Homepage Spotlight and event promotion. The product description, price, currency and duration shown at purchase form part of that purchase.

A profile boost or Homepage Spotlight increases distribution/visibility for its stated period. Homepage Spotlight also requires the member’s separate consent to public pre-login placement and an active profile-verification badge. It does not guarantee profile views, Likes, G’Days, Winks, matches, messages, dates or a relationship. Paid visibility never lets a member bypass mutual matching to send private messages.

Payments may be processed by Stripe Checkout or PayPal, depending on the provider configured by G’Dayte. We may retain transaction references and payment status needed to activate, support and audit the purchase.

Australian Consumer Law: nothing in these Terms excludes, restricts or modifies consumer guarantees or other rights that cannot lawfully be excluded. Where you are entitled to a remedy under applicable law, these Terms do not remove that entitlement.

7. Referrals, Founding 500 and benefits

Referral rewards, Founding 500 places, badges and member benefits are subject to the eligibility/rules displayed at the time. We may refuse or reverse rewards obtained through fake accounts, self-referral abuse, automation, duplicate accounts or other manipulation.

A genuine assigned Founding 500 number is intended to remain associated with that member account, subject to account deletion, fraud correction or enforcement. Monthly benefits can change, expire, have limited availability or be supplied by a third party.

8. Giveaways, competitions and member polls

G’Dayte may run free member giveaways, judged competitions and polls. Each promotion may have its own eligibility, opening/closing dates, prize, judging or draw method and additional rules shown with the promotion. Unless expressly stated otherwise, buying Premium, boosts or other paid visibility does not improve your chance of winning. We may reject duplicate, automated, fraudulent or ineligible entries. Poll results are community feedback, not scientific research.

9. Events and third-party places

G’Dayte may list or promote events and local businesses. Unless an event is expressly identified as operated by G'Dayte Australia, the venue/organiser is responsible for the event itself, including entry conditions, accessibility, cancellations and conduct at the venue.

Use your own judgment when meeting someone. Tell someone you trust, meet in a public place, arrange your own transport and follow the Safety Centre guidance.

10. Advertising and third-party services

Some non-chat pages may display advertising, including AADS. Private G’Dayte message pages do not show the G’Dayte display ad unit. Third-party services such as Stripe, PayPal, mail providers, advertisers and external event sites have their own terms and privacy practices.

11. Service availability and changes

We aim to keep G’Dayte available and reliable but cannot promise uninterrupted or error-free operation. We may maintain, change, add, remove or test features, provided we do not misrepresent paid purchases already supplied. We may introduce optional paid features, but the current core free interaction promise is stated transparently on the service.

12. No guarantee of member identity or outcomes

Verification badges mean only what G’Dayte expressly says they mean. Email verification, photo/profile verification and Founder/Ambassador badges are not guarantees that a person is safe, truthful, compatible or who they claim to be in every respect.

G’Dayte does not guarantee that you will receive Likes, matches, messages, dates or any particular relationship outcome.

13. Intellectual property

The G’Dayte name, site design, software, logos and original service content are owned by or licensed to the operator. These Terms do not give you permission to copy the service, reverse engineer restricted parts of it, scrape member data or use G’Dayte branding in a way that implies endorsement.

14. Pausing, deletion and termination

You can turn off discovery or delete your account using the available account controls. We may suspend or terminate accounts for serious or repeated breaches, fraud, safety risks, legal requirements or service abuse.

Deleting an account anonymises/removes it from active discovery. Messages already sent may remain visible to the recipient and relevant safety, financial or audit records may be retained where reasonably necessary, as explained in the Privacy Policy.

15. Liability and mandatory rights

To the maximum extent permitted by law, G’Dayte is not responsible for the independent conduct of members, venues or third parties outside our reasonable control. You are responsible for decisions about whether, when and where to meet another person.

Nothing in this section limits liability or rights that cannot lawfully be limited or excluded, including applicable Australian Consumer Law rights.

16. Changes to these Terms

We may update these Terms as the service or law changes. Material changes may be communicated through the site or service email. Where appropriate, we may ask members to accept an updated version before continuing to use affected features.

17. Governing law

These Terms are governed by the laws applicable in New South Wales, Australia, subject to any mandatory rights or jurisdiction rules that apply to you.
